The Platform and its original content, features, and functionality are owned by Swordfish and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use our trademarks, logos, or other proprietary information without our express written consent.
In no event shall Swordfish or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Platform, even if Swordfish or a Swordfish authorized representative has been notified orally or in writing of the possibility of such damage.
You agree to indemnify and hold harmless Swordfish, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Platform or violation of these Terms.
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Platform will immediately cease.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Swordfish operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
